Conditions Federal Edward Byrne Memorial Justice Assistance Grant (JAG) funding on State compliance with federal immigration rules. States that issue driver licenses without verifying U.S. citizenship or lawful presence, or that prohibit sharing immigration‑related information with the Department of Homeland Security (DHS), must return unobligated JAG funds and are barred from future grants until the State law or policy changes.
The law defines key terms used for enforcement and requires that any return of funds follow specified procedures within 30 days after a triggering determination. The practical effect is to use grant eligibility to pressure States to adopt immigration verification and information‑sharing practices consistent with federal policy.
