The bill expands accessible, multilingual plain-language guidance and compliance tools for immigrants and small businesses—reducing confusion and audit risk—but may chill discussion of employer misconduct, introduce enforcement-side bias into materials, and impose modest administrative costs on the SBA.
Immigrants and small-business employees will receive free, plain-language guidance (provided in English, the 15 most common non-English languages, and ASL) about immigration-enforcement rights and how to respond during workplace inspections or arrests.
Small-business owners will get practical I-9 and audit-preparedness materials that improve compliance and readiness for employer audits, reducing the risk of penalties.
Users of the materials will see clear disclaimers directing them to legal counsel, which reduces the chance the materials are misinterpreted as legal advice.
Immigrants and small-business owners may be discouraged from discussing employer misconduct or accessing full legal information because the materials prohibit 'blaming' or restrict certain language, creating a chilling effect on speech and complicating nuanced guidance about legal violations.
Small businesses and immigrants could receive guidance that favors enforcement-side interpretations if SBA materials reflect the perspectives of consulted agencies, limiting defense-oriented advice and potentially biasing users toward enforcement views.
Taxpayers and the SBA will incur administrative costs to develop, translate, consult with DHS/EOIR, and distribute materials within 180 days, likely requiring resources or reallocation.
Based on analysis of 2 sections of legislative text.
Requires SBA to create multilingual educational materials for small businesses and workers about immigration enforcement rights, I-9 compliance, and audit responses, to be published within 180 days.
Official title: To amend the Small Business Act to help owners and employees of small business concerns understand their rights and responsibilities with respect to immigration enforcement, and for other purposes.
Introduced July 23, 2026 by Nydia M. Velázquez · Last progress July 23, 2026
Requires the Small Business Administration to create and distribute clear, multilingual educational materials for small business owners and employees about immigration enforcement rights, employer responsibilities, I-9 compliance, and how to respond to audits or inspections. Materials must include online modules, a printable/electronic pocket card, and planning/compliance tools, be vetted with relevant agencies and experts, be available in the 15 most common non-English languages plus ASL, and be completed and published within 180 days of enactment. The law also forbids materials that blame owners or employees for immigration status or that discourage use of SBA services based on immigration status, and it authorizes distribution through SBA regional/district offices and trusted resource partners.
