Requires nearly all noncitizens on ICE’s nondetained docket to be enrolled in Alternatives to Detention (ATD), wear continuous GPS monitoring, and observe a nightly 10:00 p.m.–5:00 a.m. home restriction for the length of their immigration case (including appeals) and, if ordered removed, until removal. It also tightly limits when ATD can be used by allowing release to ATD only after all detention beds are filled and after the Secretary has exhausted all efforts to detain.
Adds a rule that an immigration officer’s affidavit alleging an alien violated a release condition triggers an in‑absentia removal order, and includes a severability clause so remaining provisions stay in effect if part of the law is struck down. The bill does not include new funding or implementation details for monitoring, detention capacity, or legal process changes.
