Disapproves and nullifies the Office of the Comptroller of the Currency’s rule about how the OCC reviews Bank Merger Act applications (published at 89 Fed. Reg. 78207, Sept. 25, 2024). The resolution declares that rule to have no force or effect.
Because this is a Congressional disapproval under the Congressional Review Act, the OCC cannot reissue the same rule in substantially the same form without new statutory authority. The action affects how bank merger applications will be reviewed until the OCC issues a different, permitted rule or implements a new policy.
Referred to the House Committee on Financial Services.
