Removes “premium cigars” from the Federal Food, Drug, and Cosmetic Act’s definition of “tobacco product,” which takes these cigars out of FDA’s tobacco regulatory framework.
Defines “premium cigar” with a strict, eight-part test that all products must meet to qualify—such as being wrapped in whole tobacco leaf, handmade, and having no characterizing flavor other than tobacco. Products that fail any criterion (e.g., flavored, filtered, machine‑made, or mass‑market cigarillos) would remain regulated as tobacco products.
