Adds new section 2799A–11 to Part D of the Public Health Service Act establishing coverage requirements for auditory implant devices, external sound processors, related maintenance, upgrades, repairs, assessments, surgery, postoperative care, and a prohibition on denial when determined medically necessary; defines 'qualifying individual'.
Adds new section 726 to subtitle B, part 7, of title I of ERISA requiring group health plans and health insurance issuers offering group coverage to provide coverage for auditory implant devices, external sound processors and related services, including maintenance, upgrades, assessments, surgery, postoperative care, and a prohibition on denial when determined medically necessary.
Amends the ERISA table of contents (section 1) by inserting a new item for section 726 after the item for section 725.
Adds new section 9826 to Subchapter B of the Internal Revenue Code establishing a requirement that group health plans provide coverage for auditory implant devices, external sound processors, and related services (maintenance, upgrades every 5 years, repair, assessments, surgery, postoperative care, aural rehabilitation), and prohibiting denial when determined medically necessary; defines 'qualifying individual'.
Amends section 1251(a)(4)(A) of the Patient Protection and Affordable Care Act to broaden the phrase referencing applicable provisions to include those 'as added after the date of the enactment of this Act' and to add a new clause (v) making the newly added PHSA section (2799A–11) applicable to grandfathered health plans.
