Removes a statutory exclusion from the Consumer Product Safety Act's definition of “consumer product,” which brings a previously excluded category of articles into the Consumer Product Safety Commission’s (CPSC) jurisdiction. By deleting that exclusion, the change would allow the CPSC to apply its safety rules, testing, labeling, reporting, and recall authority to items that had been expressly carved out of the consumer-product definition. The immediate effects would fall on manufacturers, importers, distributors, and retailers of the newly-covered articles (and their customers), who could face new safety testing, reporting obligations, compliance costs, and potential recalls. Regulators would gain authority to set and enforce safety requirements over that category of products; courts and stakeholders may see legal challenges over the scope of CPSC authority and preemption questions.
