Adds a new section to title 18 prohibiting the use of a nonviolent 'panic' defense based on an individual’s gender, gender identity or expression, or sexual orientation; permits admission of evidence of prior trauma under the Federal Rules of Evidence; and requires an annual report to Congress on related prosecutions.
Amends the table of sections for chapter 1 of title 18 by adding an entry for the new section added at the end of the chapter.
This bill would stop people in federal criminal cases from using a “panic” defense based on someone’s sexual orientation or gender identity. It says a nonviolent sexual advance—or simply learning or believing that someone is gay, lesbian, bisexual, transgender, or nonbinary—cannot be used to excuse the crime or to ask for a lighter punishment. Judges could still consider proof that the defendant has past trauma, if allowed by normal evidence rules.
