Changes the Freedom of Information Act (FOIA) definition for certain federally established entities so that FOIA’s coverage is determined by when a request is made rather than when the requested records were created. The amendment applies to any FOIA request made on or after the date the law is enacted.
The change affects how requests for records held by entities created by federal statute are handled going forward; agencies that house those records will need to apply the revised FOIA rule to new requests regardless of the records’ age, and requesters (journalists, researchers, members of the public, and oversight bodies) may see altered access outcomes as agencies update policies and procedures.
