Adds a new subparagraph (F) to paragraph (2) establishing special rules for paraprofessionals and education support staff for purposes of the FMLA hours-of-service eligibility determination, requiring employer recordkeeping, and adding related definitions.
Adds a new paragraph (6) to subsection (a) requiring the Secretary to provide methods for calculating the leave described in paragraph (1) with respect to covered educational employees, in accordance with section 108 as applicable.
This bill makes it easier for school support staff and paraprofessionals to qualify for family and medical leave under federal law. It says these workers meet the hours rule if they worked at least 60% of the monthly hours expected for their job, based on the prior school year. It also requires school employers to keep records of the expected monthly hours for each job each school year. The government will set clear methods for how to calculate leave for these workers.
Who is affected includes paraprofessionals and education support staff such as office staff, bus drivers, cafeteria workers, custodians, health and student service staff, tech staff, and skilled trades.
